Zaitun Marketing Sdn Bhd -V- Boustead Eldred Sdn Bhd (Formerly Known As Boustead Trading (1985) Sdn Bhd) - An Update

Reference is made to our earlier announcement dated 8 October 2007.

The case came up on 9 November 2007 for hearing of Boustead Eldred Sdn Bhd ("BESB")'s application to set aside the ex-parte injunction order, and mention of Zaitun Marketing Sdn Bhd ("Zaitun")'s inter partes application for the extension of the said injunction.

The High Court granted an adjournment of the hearing to allow Zaitun to reply to BESB's latest affidavit, with a holding over of the ex-parte injunction order dated 20 September 2007 and varied on 8 October 2007 to be still effective.

The High Court also fixed 4 January 2008 as the hearing date of Zaitun's inter partes application for an extension of the said injunction, and mention date for BESB's application to set aside the injunction.

The Directors, in consultation with the legal counsel, are of the opinion that BESB will be able to set aside the ex-parte injunction order as the order was obtained without merits.
